More Teeth Put Into the Carefree Noise Ordinance 

Many of you remember the Noise Ordinance issues that have been going on in Carefree for the last few years. There were some residents that wanted everyone on 2 wheels with loud pipes to be locked up for creating too much noise, and there were some cooler heads in the Town and on the Council that wanted to try and work with the riders through an awareness campaign and a plea for voluntary noise reduction.  For the last year Carefree instituted a moratorium on writing noise violation tickets while placing signs, flyers and media exposure to remind riders to ride at lower RPM's and higher gears to minimize excessive noise while riding through the Town of Carefree. 
 
The year of the moratorium is now over and the Town Council recently had a meeting to address the findings of the voluntary noise reduction campaign over the last 12 months. The good news is that there was a general consensus that the riders had in fact complied and that there was a noticeable decrease in the noise levels throughout the area. The bad news is that they made the penalties much more severe. I talked with Councilman Lloyd Meyer, a strong advocate of the voluntary campaign about the meeting. Meyer said, "I gave an overview of where we had been and the success of the voluntary effort. A few days prior to the meeting, I had asked for public opinions about the noise issue through our COINS Internet communication program, and received over 40 responses in just a couple hours.  Most were very positive about the reduction in motorcycle noise, and actually referred to noise from construction vehicles and other sources as having gotten worse.  The noise issue is clearly being viewed in the larger context now and not being limited to any particular category."
 
Now that the majority of riders are respectful of the noise issues in the area, the council decided to put some teeth into the ordinance to deal with those that are intentionally making noise. Meyers states that "The revision to our noise ordinance was in basically two areas.  It resolves some inconsistencies between the EPA and state statute decibel levels (see page 30 in the .pdf) with what we had in our ordinance, and provides the option of bringing civil proceedings in lieu of or in addition to pursuing criminal prosecution as a Class 1 misdemeanor.  This gives the prosecutor the flexibility of going either way. We are only interested in pursuing the really flagrant violators and we believe our ordinance as revised will give us the tools to do that.  We stayed away from the whole muffler labeling issue which could have become very onerous.  It is already included in state statutes, so I described it as an option but that it was not being included in our ordinance.  I stated that we were only going to enforce the end result of actual noise created, not try to determine whether or not mufflers are in compliance with EPA standards.  It's really a behavioral issue."
 
When I asked Lloyd what his view was of the voluntary noise reduction campaign, he said "I think this is a very positive result and that we can view our voluntary program as having been generally successful.  There will always be a few bad apples, and law enforcement is prepared to deal with them, which they will now start doing, so you might want to get that word out.  We've operated for over a year now without issuing any noise citations, so I really don't think we're going to have many violations in the future. The campaign and the riders response to it has definitely made a difference." 

So it sounds like to me that the overall desired results were met and that the law enforcement will be focusing on those that are clearly flagrant violators. And with the possibilities of being charged with a Class 1 misdemeanor for those actions, the price of poker has definitely gone up. Violators could be fined as much as $2,500, receive as much as three years probation or land in jail for up to 180 days. Currently, the civil penalty on a first-time offense carries a fine of up to $175, according to the Carefree town code. The one thing that bothers me in this whole thing is the fact that which charges are written is up to the arresting officer and then ultimately upheld by the prosecutor. I would like to see something a little more objective for that citation. It leaves just a little too much up to the officer. If he doesn't like the way you trimmed your mustache that day, or the way that you answered his questions, you could end up with the Class 1 Misdemeanor instead of the Civil fine. So beware if you choose to let your presence be known a little too much when riding through Carefree. There are also rumors that other popular riding destinations around the State are looking into the Carefree ordinances. So keep it down in these small towns to keep from going through this elsewhere.
 
But things could be a lot worse. Some of you might have heard about the new law in Denver Colorado. They have gone way past what we are dealing with here and into the unthinkable, which could actually be our future. The new law passed by the Denver City Council essentially requires all riders in the city to use only stock exhaust systems on their motorcycles. On June 4, Denver officials approved changes to the city's vehicle noise ordinance that allow police to issue tickets to riders if their bikes don't have a federal Environmental Protection Agency sound-certification label on the exhaust systems. The new ordinance, which takes effect July 1, would apply to all motorcycles made since 1982, which was the first year that federal law required motorcycles sold in the U.S. to comply with EPA sound regulations. In practical terms, that means the bike would have to have the original exhaust system installed by the manufacturer. Violators would have two weeks to prove to a judge that they have fixed the problem or would be forced to pay a $500 fine. Click Here for a recent article about Denver. Chandler Harley-Davidson Two Wheeled Tuesdays.

The first Tuesday night was a huge success with over 350 motorcycles coming through the Tilted Kilt to take part in the 9-11 Tribute. Bike night is every Tuesday night with food and drink specials, but Chandler Harley will be doing a special with live music the first Tuesday of every month. For October, look forward to Biketoberfest night at the Kilt. There will be Raffles, Vendors, Bike Competition, Portable Dyno Competition. Watch next week for weekly event specials. Ride For Kids. Join hundreds of other motorcyclists for a scenic ride through the Arizona countryside. You’ll have a great time while raising funds for the PBTF's medical research and family support programs! Riders on all makes and models are welcome. Registration opens at 8 a.m. and closes at 9:45 at Desert Ridge Junior High School located at 10211 E. Madero Ave. in Mesa, AZ. The police-escorted ride starts at 10 a.m. sharp, rain or shine! The ride will loop back to Desert Ridge Junior High School. After a light lunch, participants will enjoy a Celebration of Life program that features interviews with young brain tumor survivors—the Ride for Kids® "stars" of the day. Award presentations to top fundraisers and distribution of premiums will follow. The minimum donation to ride is $35.

Officer Nick Erfle Children's Education Fund Support Ride. Many of you have heard about the terrible tragedy of Phoenix Police Officer Nick Erfle, who was gunned down on the streets of Phoenix by an illegal immigrant who had been deported many times before. Kansas Concert at Westgate. Cyclerides.com is partnering with Westgate City Center in Glendale, AZ to bring to you one of the most popular Classic Rock bands of the 70's and 80's, KANSAS!

That's Right! KANSAS will be appearing live on stage adjacent to the Dancing Fountains at Westgate, next to the Coyotes Arena on Friday, October 19th. 11th Annual Choir Boys Run. Register at Chester's Harley Davidson - 922 S Country Club Dr., Mesa. This is always a good run. Registration starts at 8:00. Donation: Rider - $15.00, Passenger - $5.00. Last bike out, 10:30 am.  Final Destination is Six Shooters located at 705 S Rural Rd, Tempe. Raffles, Door Prizes, Auctions, 50/50, VENDORS, Live Band, Lunch, T-Shirts sold at the event. I had so many of you email and want the OLD classifieds back that I have finally gotten it done.
The reason I dropped them before is that I didn't have time to do it as it was set up. Recently I had a programmer build me a classifieds page that you can automatically add your own Bikes, Parts and ATV's. Then you can upload up to 5 photos of what you are selling. It is very basic and easy to use. There is even a search function available that will separate out Parts or whatever brand that you are looking for. The cost for the Cyclerides.com Classifieds is going to be only be $10 for 60 days. This page was previously one of the most viewed pages on the site from all over the country. To get the page up and running, until Tuesday Oct. 16th, you can add your bikes, parts and ATV's for FREE. Just put 1234 in both credit card and expiration spots when you list your bike.
